Bylaw #4: Loitering

BE IT ENACTED by the Community Council of North Rustico that:

1. (a) No person or persons shall loiter or congregate without just cause and without the consent of the Community Council of North Rustico on any street, on or about the grounds or premises of any public building or in any public place within the Community of North Rustico after the hour of 10:00 pm daily;

(b) No person or persons shall loiter or congregate within or about the grounds of the North Rustico Centennial Park after dusk on any day except with the consent of the Community Council of North Rustico;

(c) No person or persons shall, within the Community of North Rustico, physically, verbally or otherwise obstruct, molest, harass, or interfere with any person or persons on any street, parking lot, on or about the grounds of any public building or in any public place. This subsection shall not apply to those engaged in the performance of public duties on behalf of the Community Council or any other governmental or administrative agency, board, or body;

2. (a) Any person who violates the provisions, or any one of them, of section 1 hereof shall be guilty of an offense and liable upon summary conviction to a fine of not less than $25.00 and not more than $100.00;

(b) A prosecution for any violation of this bylaw shall be heard by a Provincial Court Judge or any other judge appointed and having jurisdiction to hear such prosecution.

 

This bylaw shall come into full force and effect on the 27th day of June 1988.
